Moral and good sense considerations about the pandemic

In the first case, the answer is simple there is a possibility of discriminating between the embryos affected by the genetic disease and those which are not. The parents then make their decision according to their faith and their convictions. It is therefore useless to constrain. It is the freedom and responsibility of parents that guide our actions.

In the second case, the individual who infects a sexual partner when he knows he is infected with a virus such as AIDS can be accused and sentenced given the seriousness of the infection he has transmitted. It is therefore the law that determines whether there is a need to compel an individual to make reparation and where to be imprisoned for a serious fault since he was aware and he does not protect his partner. If the individual is not aware that he is carrying a virus whose transmission can be serious or fatal, it is up to him to prove it. The fact remains that if the transmission is proven, the damage caused, albeit unintentional, must be repaired. It is the rule of law that guides our response as a society.

But the comparison is not right. The comparison of covid-19 with the two previous cases is weak, covid-19 is an active pandemic with high mortality and for which for months we did not have a vaccine or an effective antiviral. Under these conditions urgent measures are justified and human common sense has recognized this for a very long time; just refer to the Bible, Leviticus 13, the priests were responsible for isolating infected people and checking that they could come out of the isolation because they were cured. There are restrictions of freedom that decrease transmission and avoid deaths in a pandemic. These restrictions are not justified before, nor after and overall not as soon as we have vaccines and drugs to avoid deaths.

Dans le second cas, l'individu qui infecte un partenaire sexuel alors qu'il se sait infecté par un virus tel que le SIDA peut être accusé et condamné compte tenu de la gravité de l'infection qu'il a transmise. C'est donc la loi qui détermine s'il y a lieu de contraindre un individu à réparer et où l'incarcérer pour une faute grave puisqu'il en a eu connaissance et qu'il ne protège pas son partenaire. Si l'individu n'a pas conscience d'être porteur d'un virus dont la transmission peut être grave ou mortelle, c'est à lui de le prouver. Il n'en reste pas moins que si la transmission est avérée, les dommages causés, bien qu'involontaires, doivent être réparés. C'est la primauté du droit qui guide notre réaction en tant que société.

Mais la comparaison n'est pas bonne. La comparaison du covid-19 avec les deux cas précédents est faible, le covid-19 est une pandémie active avec une forte mortalité et pour laquelle pendant des mois nous n'avions ni vaccin ni antiviral efficace. Dans ces conditions, des mesures urgentes sont justifiées et le bon sens humain l'a reconnu depuis très longtemps ; il suffit de se référer à la Bible, Lévitique 13, les prêtres étaient chargés d'isoler les personnes infectées et de vérifier qu'elles pouvaient sortir de l'isolement car elles étaient guéries. Il existe des restrictions de liberté qui diminuent la transmission et évitent les décès lors d'une pandémie. Ces restrictions ne se justifient ni avant, ni après et surtout pas dès qu'on a des vaccins et des médicaments pour éviter les décès.
